1. What This Policy Covers

This page explains how to tell us that something on denwix.com uses your copyrighted work without permission. It also explains what we do once you tell us, and what you can do if we remove something of yours by mistake.

Our procedure mirrors the one laid down by the Digital Millennium Copyright Act, or DMCA. Therefore the steps below will look familiar if you have sent a notice to another website before.

2. Our Position on Copyright

We write our own copy, and we build our own pages. In return, we ask others to respect ours.

If your work has ended up here without your permission, we want to know. Honestly, we prefer a quick fix to a long dispute. Send us a notice and we will look at it properly.

3. How to Report Infringement

First, find the exact page. Then copy its full web address from your browser.

Next, write down what the page copies and where your original sits. Finally, email us the notice described in the next section.

Please send one notice per complaint. Otherwise a long list becomes hard to act on, and your request takes longer.

4. Details Every Takedown Notice Needs

The law asks for six things. Consequently a notice without them may not be valid, and we may have to come back to you for more.

• The name, postal address, phone number and email of the person who owns the work.
• Details of the original work you believe someone copied. If it lives online, include the link to the original.
• The full address of every page on denwix.com you are reporting.
• Your good faith statement that neither you, your agent nor the law allowed this use.
• Your confirmation that every detail in the notice is correct. In addition, state under penalty of perjury that you are the copyright owner or are authorised to act for them.
• A signature from you, on paper or in electronic form.

Please keep the wording plain. Above all, be specific about which page and which part of it you mean.

5. The Address for Takedown Notices

Email is the fastest route, so please use it where you can. Put "DMCA notice" at the start of the email subject.

We read every message. However, we cannot promise a reply to notices that leave out the six items above.

6. What Happens Next

We aim to acknowledge your notice within two working days. After that we check the page you reported.

If the claim looks valid, we remove the material or take the page down. Meanwhile we keep a record of what we removed and why.

If the material came from someone else, we tell them what was removed. Then we pass on a copy of your notice, including the contact details in it, because the law requires that.

7. When We Take Down Something You Posted

Mistakes happen. So if we removed something of yours and you believe we were wrong, you can send a counter-notice.

Use that same inbox for it. Next, Denwix forwards your counter-notice to whoever filed the claim.

Should they not file a court case within 10 to 14 working days, the material may return. Meanwhile, the material stays offline.

8. Details a Counter-Notice Has to Contain

• The name, postal address, phone number and email of the person who owns the work.
• A description of what was removed, plus where it appeared before it came down.
• Your sworn statement, made under penalty of perjury, that you honestly believe the removal was a mistake or a mix-up.
• A statement that you accept the jurisdiction of the courts where you live, or of a federal district court if you live outside the United States.
• Your agreement to accept legal papers from whoever filed the first notice.
• A signature from you, on paper or in electronic form.

As with a notice, we forward your counter-notice in full. Leave out anything you would mind the other side reading.

9. Repeat Infringers

Denwix logs every valid complaint it receives. Anyone who keeps posting other people’s work loses access to Denwix services.

This applies to comments, submitted content and anything sent through our tools. In short, one mistake is a mistake, but a pattern is a decision.

10. False or Careless Claims

Under the DMCA, a person who knowingly makes a false claim can be liable for damages. That includes the legal costs of the person they accused.

So please check first. If you are not the owner and not authorised to act for them, do not send a notice.

11. What We Cannot Do

We can only act on material we host or control. Denwix does not run other people's websites, so we cannot remove anything from them.

Likewise we cannot remove pages from search results. That is Google's to do, and they have their own form for it.

Finally, we cannot decide who owns a work, and this page is not legal advice. If ownership is genuinely disputed, that belongs in court rather than in our inbox, so speak to a lawyer before you rely on anything here.

12. Changes to This Policy

This policy may change when our services grow or the law shifts. Check the revision date above to see which DMCA policy version applies.

Edits to this DMCA policy apply as soon as Denwix publishes them. Therefore it is worth checking this page before you send anything.
